Welcome to Bramble & Bluegrass! These Terms of Service (“Terms”) govern your access to and use of the Bramble & Bluegrass website, online store, products, and related services (collectively, the “Services”).

Throughout these Terms, the words “we,” “us,” “our,” and “Bramble & Bluegrass” refer to Bramble & Bluegrass. The words “you” and “your” refer to the person accessing or using our Services.

Our store is hosted by Shopify, which provides the online commerce platform that allows us to offer our products and Services to you.

Please read these Terms carefully before using our website or placing an order. By accessing, browsing, or using our Services, or by purchasing a product from us, you agree to be bound by these Terms and any policies referenced within them, including our Privacy Policy, Shipping Policy, and Refund & Return Policy.

Bramble & Bluegrass offers a curated selection of home décor, candles, wax melts, gifts, personal-care items, and other lifestyle products.

We make reasonable efforts to accurately display product descriptions, photographs, colors, dimensions, ingredients, materials, and other product information. However, colors and product appearance may vary depending on your device, screen settings, lighting, photography, manufacturing variations, handmade characteristics, or other factors.

Some products are handmade, small-batch, customized, personalized, made-to-order, or otherwise produced individually. Minor variations in appearance, color, texture, scent, finish, packaging, or dimensions may occur and may not constitute a defect.

Product descriptions, prices, availability, packaging, and other information may change at any time without notice.

We reserve the right to discontinue products, limit quantities, or refuse to sell products to any person, geographic region, or jurisdiction when permitted by law.

Independent Suppliers and Fulfillment Partners

Some products offered through Bramble & Bluegrass are created, manufactured, packaged, or shipped directly by independent creators, makers, manufacturers, brands, suppliers, or fulfillment partners (“Fulfillment Partners”).

Because different products may come from different Fulfillment Partners:

  • Processing and shipping times may vary by product.
  • Products in the same order may arrive in separate packages.
  • Packaging and shipping locations may vary.
  • Product-specific instructions, warnings, restrictions, and return requirements may apply.
  • Certain products may be final sale or otherwise ineligible for return or exchange.
  • Certain products may have different cancellation, return, replacement, or refund requirements.

Where a product is subject to product-specific restrictions or supplier requirements, those requirements may apply in addition to our general Refund & Return Policy.


SECTION 3 – ORDERS AND ACCEPTANCE

When you place an order through our website, you are making an offer to purchase the products in your order.

An order confirmation acknowledges that we have received your order but does not necessarily mean that every item in the order has been finally accepted for fulfillment.

We reserve the right to refuse, cancel, modify, or limit an order for reasons including, but not limited to:

  • Product availability;
  • Pricing or listing errors;
  • Product or inventory discrepancies;
  • Suspected fraudulent or unauthorized transactions;
  • Shipping limitations;
  • Supplier or fulfillment restrictions;
  • Errors in your order or shipping information; or
  • Other circumstances that require us to cancel or modify an order.

If we cancel or modify an order after payment has been received, we will issue an appropriate refund for the affected portion of the order.

Please review your order carefully before submitting it. Once an order has been submitted to a Fulfillment Partner for processing, we may not be able to accommodate cancellation or modification requests.

Cancellation requests are not guaranteed until confirmed by Bramble & Bluegrass.

Certain customized, personalized, made-to-order, or already-processed products may not be eligible for cancellation once production or fulfillment has begun.

All purchases are subject to our Refund & Return Policy and any applicable product-specific terms.

Unless otherwise agreed to in writing, products purchased through Bramble & Bluegrass are intended for personal or household use and not for unauthorized resale.


SECTION 4 – PRICES, BILLING, AND PAYMENT

All prices are displayed in U.S. dollars unless otherwise stated.

Prices, discounts, promotions, and product availability may change at any time without notice.

The price charged for a product will generally be the price displayed at the time your order is placed and will be reflected in your order confirmation.

Unless otherwise stated, applicable sales taxes and shipping charges will be calculated and displayed during checkout.

You agree to provide accurate and complete billing, payment, contact, and shipping information.

By submitting payment information, you represent that:

  • The payment information you provide is accurate and complete;
  • You are authorized to use the payment method provided;
  • The payment method will be honored by your payment provider; and
  • You agree to pay all charges associated with your purchase, including applicable taxes and shipping charges.

We reserve the right to correct pricing errors and, where permitted by law, cancel orders affected by material pricing or listing errors.


SECTION 5 – SHIPPING AND DELIVERY

Bramble & Bluegrass works with independent creators, makers, manufacturers, suppliers, and fulfillment partners who may ship products directly to customers.

Because products may be fulfilled from different locations, items purchased in the same order may arrive in separate packages and at different times.

Processing and delivery times are estimates unless a specific delivery guarantee is expressly stated.

We are not responsible for delays caused by shipping carriers, weather, holidays, customs processing, carrier disruptions, incorrect or incomplete shipping information, inaccessible delivery addresses, failure to retrieve a package, or other circumstances beyond our reasonable control.

You are responsible for providing a complete and accurate shipping address and for promptly notifying us of any changes before an order enters fulfillment.

If a package is returned to a Fulfillment Partner because of an incorrect, incomplete, inaccessible, or undeliverable address, additional shipping charges, handling fees, replacement requirements, or other supplier-specific terms may apply.

SECTION 6 – REFUNDS, RETURNS, EXCHANGES, AND CANCELLATIONS

Our Refund & Return Policy governs returns, refunds, exchanges, replacements, and related requests.

Because Bramble & Bluegrass works with multiple Fulfillment Partners, return and refund eligibility may vary by product.

Some products may have:

  • A limited return period;
  • No return or exchange eligibility;
  • Final-sale restrictions;
  • Custom or personalized-product restrictions;
  • Made-to-order restrictions;
  • Product-specific return instructions;
  • Customer-paid return shipping;
  • Non-refundable original shipping charges;
  • Restocking fees; or
  • Other supplier-specific requirements.

We will make reasonable efforts to clearly communicate applicable restrictions through our Refund & Return Policy, product listings, or customer service communications.

A return or refund request does not automatically guarantee approval.

Where a product must be returned to a Fulfillment Partner, the customer may be required to follow the supplier’s return instructions and requirements.

Customers should not send products to a supplier or other address unless instructed to do so by Bramble & Bluegrass or the applicable Fulfillment Partner.


SECTION 7 – CANDLES, WAX MELTS, AND HOME-FRAGRANCE PRODUCTS

Candles, wax melts, fragrance products, and other home-fragrance products should always be used responsibly and according to the safety instructions provided with the product.

Never leave a burning candle unattended.

Keep candles and wax products away from children, pets, flammable materials, drafts, and other potential hazards.

Customers are responsible for following all manufacturer-provided safety instructions and using products only for their intended purposes.

If a product includes specific safety instructions or warnings from its creator or manufacturer, those instructions should be followed.

To the maximum extent permitted by applicable law, Bramble & Bluegrass is not responsible for damage, injury, fire, property damage, or loss resulting from improper use, misuse, neglect, failure to follow safety instructions, or use of a product contrary to its intended purpose.

Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited.


SECTION 8 – PRODUCT INFORMATION, INGREDIENTS, AND INDIVIDUAL SENSITIVITIES

Products may be handmade, naturally formulated, fragranced, or manufactured using ingredients or materials that may affect individuals differently.

Product descriptions and ingredient information are provided for informational purposes and may be supplied by the applicable creator, manufacturer, or supplier.

If you have allergies, sensitivities, dietary restrictions, or other concerns regarding an ingredient or material, you should review the product information carefully and contact us before purchasing when additional information is needed.

Bramble & Bluegrass does not guarantee that a product will be suitable for every individual’s particular needs or sensitivities.

All original content associated with Bramble & Bluegrass, including our name, logo, branding, website design, written content, graphics, photographs, and other original materials, is owned by or licensed to Bramble & Bluegrass and is protected by applicable intellectual property laws.

You may not reproduce, distribute, modify, copy, publish, sell, create derivative works from, or otherwise exploit our original content without our prior written permission.

The names, logos, trademarks, photographs, product designs, and other intellectual property belonging to third-party creators, manufacturers, suppliers, or brands remain the property of their respective owners.

Nothing in these Terms grants you ownership or a license to use any Bramble & Bluegrass or third-party intellectual property except as expressly permitted.

Bramble & Bluegrass is not responsible for the content, policies, practices, or availability of third-party websites that you choose to access.

Where a third-party supplier or Fulfillment Partner provides product-specific information, warranties, instructions, or requirements, those materials may apply to the applicable product.


SECTION 11 – SHOPIFY

Bramble & Bluegrass uses Shopify to provide the technology and platform that powers our online store.

Purchases made through our website are transactions between you and Bramble & Bluegrass.

Shopify provides the platform through which our store operates but is not the seller of products purchased from Bramble & Bluegrass.

To the extent permitted by applicable law, you agree that Shopify and its affiliates are not responsible for disputes, claims, losses, injuries, damages, or other liabilities arising from products purchased directly from Bramble & Bluegrass.

Your use of our Services is also subject to our Privacy Policy.

By using our website, you acknowledge that information submitted through our Services may be collected, processed, stored, and shared with service providers and applicable Fulfillment Partners as necessary to operate our store, process payments, fulfill orders, provide customer service, process returns or replacements, prevent fraud, and otherwise provide the Services.

Depending on the product and fulfillment method, information necessary to complete an order may be provided to the applicable creator, maker, manufacturer, supplier, or fulfillment partner.

Because our store is hosted by Shopify, Shopify may also process information associated with your use of our website.

SECTION 13 – CUSTOMER REVIEWS AND FEEDBACK

If you voluntarily submit reviews, comments, photographs, suggestions, ideas, or other content to Bramble & Bluegrass (“Feedback”), you grant Bramble & Bluegrass a non-exclusive, worldwide, royalty-free license to use, reproduce, display, publish, modify, and distribute that Feedback for purposes related to operating, promoting, and improving our business.

  • You own or have permission to provide the Feedback;
  • Your Feedback does not violate another person’s rights;

PRODUCTS MAY BE MANUFACTURED OR FULFILLED BY INDEPENDENT THIRD PARTIES, AND WE DO NOT WARRANT THAT EVERY THIRD-PARTY FULFILLMENT OPERATION, MANUFACTURING PROCESS, OR SHIPPING SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE.

NOTHING IN THESE TERMS IS INTENDED TO EXCLUDE OR LIMIT ANY WARRANTY, RIGHT, OR PROTECTION THAT CANNOT LEGALLY BE EXCLUDED OR LIMITED UNDER APPLICABLE LAW.


SECTION 18 – LIMITATION OF LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, BRAMBLE & BLUEGRASS AND ITS OWNERS, AFFILIATES, PARTNERS, CONTRACTORS, SERVICE PROVIDERS, AND LICENSORS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES ARISING FROM OR RELATED TO YOUR USE OF OUR SERVICES OR PRODUCTS.

THIS INCLUDES, TO THE EXTENT PERMITTED BY LAW, LOSS OF PROFITS, LOSS OF REVENUE, LOSS OF DATA, BUSINESS INTERRUPTION, OR OTHER SIMILAR DAMAGES.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY ARISING FROM OR RELATED TO AN ORDER OR PRODUCT WILL NOT EXCEED THE AMOUNT YOU ACTUALLY PAID TO BRAMBLE & BLUEGRASS FOR THE PRODUCT OR ORDER GIVING RISE TO THE CLAIM.

NOTHING IN THESE TERMS LIMITS LIABILITY THAT CANNOT LAWFULLY BE LIMITED OR EXCLUDED.


SECTION 19 – INDEMNIFICATION

To the maximum extent permitted by applicable law, you agree to indemnify and hold harmless Bramble & Bluegrass and its owners, affiliates, partners, contractors, service providers, and licensors from claims, damages, liabilities, losses, and reasonable expenses arising from:

  • Your violation of these Terms;
  • Your violation of applicable laws or the rights of another person;
  • Your misuse of our Services; or
  • Your intentional or negligent misconduct.


SECTION 20 – SEVERABILITY

If any provision of these Terms is determined to be unlawful, invalid, or unenforceable, that provision will be enforced to the maximum extent permitted by law, and the remaining provisions will remain in full force and effect.


SECTION 21 – WAIVER AND ENTIRE AGREEMENT

Our failure to enforce any provision of these Terms does not constitute a waiver of that provision or our right to enforce it in the future.

These Terms, together with our Privacy Policy, Refund & Return Policy, Shipping Policy, and any other policies referenced on our website, constitute the entire agreement between you and Bramble & Bluegrass regarding your use of our Services.

These Terms replace any prior agreements or communications regarding your use of our Services.


SECTION 22 – ASSIGNMENT

You may not transfer or assign your rights or obligations under these Terms without our prior written consent.

Bramble & Bluegrass may assign or transfer its rights and obligations as permitted by applicable law.
